40.150 SPECIAL EVENTS ON PUBLIC PREMISES

Ordinance No. 130 an Ordinance to provide for the use, control and protection of Village owned parks and property and to provide special permits for group activities in said parks and premises and to provide penalties therefore is hereby amended as follows:

40.151 Policy.
Sec. 1. It shall be the policy of the Village of Mackinaw City to provide public parks and public areas for the general public to use in a reasonable and orderly manner without exclusion of anyone from a park or public area, yet to protect public property, equipment and the use thereof by the general public. It shall also be the policy of the Village to attempt to provide certain public areas for specific activities based on health, safety and welfare of the residents of this Village. It is further the policy of the Village to attempt to allow all legal activities on some public area but to restrict some activities to certain places and times in an effort to coordinate the use of public areas for the benefit of all of the general public.

40.152 Activities requiring a permit.
Sec. 2. Whenever any public or private group, association or organization desires to use a park or public area for a particular purpose such as reunions, weddings, receptions, rallies, craft and car shows, theatrical or entertainment performances or for other group or civic activities, including public special events which is defined as events officially sponsored by the Mackinaw City Chamber of Commerce, the Mackinaw Area Tourist Bureau or the Village of Mackinaw City, a representative of the group, association or organization shall first obtain a permit from the Village for such purposes. Standards for issuance of said permit are as follows:

A. The proposed activity or use of the public premises will not reasonably interfere with or detract from the general public enjoyment of the area.
B. The proposed activity and use will not unreasonably interfere with or detract from the promotion of public health, safety, welfare and recreation.
C. The proposed activity or use is not reasonably anticipated to incite violence, crime or disorderly conduct.
D. The proposed activity will not entail unusual, extraordinary or burdensome expense or police operation by the Village.
E. The facilities desired have not been reserved for other use at the days and hours requested in the application.
F. Proof of liability insurance in an amount deemed satisfactory to the Village, unless waived by the Village.
G. Compliance with all regulations set forth in Section 5 of this Ordinance.

40.153 Restricted permit days.
Sec. 3 The issuing of Special Event Permits on the following days will be restricted to Public Special Events only: July 4th, Memorial Weekend and Labor Day.

40.154 Procedure to obtain permit and fees.
Sec. 4 The permit for reunions, weddings or wedding receptions can be applied for and approved by the Village Clerk’s office. Permits will be issued on a first come, first serve basis. The fee for such permit shall be set by the Village Council annually.

The permit for all other group activities described in section 2 can be applied for on a form to be provided by the Village Clerk’s office and submitted to the Village Clerk’s office not less than 30 days prior to the planned activity together with a permit fee as set by the Village Council annually. All such permits subject to approval by a majority of the Village Council. Permits will be issued on a first come, first serve basis.

The Village Council reserves the right to waive permit fees for nonprofit organizations.

40.155 Public areas limited to specific uses.
Sec. 5. The following parks/areas will be limited to the activities described herein:

A. Marina Lawn Park. Permitted activities authorized in this park will consist of musical concerts and marina/public special events; subject to the following additional requirements:
1. Time limits. No event shall be conducted earlier than 8:30 a.m. nor later than 10:00 p.m.
2. Noise limits. No event shall produce noise levels that interfere with or detract from the enjoyment of the surrounding area by the general public.
3. Limitation on use of artificial lighting. No artificial lighting will be allowed unless it is sufficiently maintained and directed within the park area and specifically shielded and directed in a way that does not cause artificial illumination of areas outside the park including the sky.
 

B. Conkling Heritage Park. Permitted activities authorized in this park will consist of musical concerts, weddings, car and craft shows and other public special events subject to the following additional requirements:
1. Time limits. No event shall be conducted earlier than 8:30 a.m. nor later than 10:00 p.m.
2. Noise limits. No event shall produce noise levels that interfere with or detract from the enjoyment of the surrounding area by the general public.
3. Limitation on use of artificial lighting. No artificial lighting will be allowed unless it is sufficiently maintained and directed within the park area and specifically shielded and directed in a way that does not cause artificial illumination of areas outside the park including the sky.
 

C. Recreation Complex. All activities authorized under this Ordinance are permitted within this Park subject to the following additional requirements:
1. Time limits. No event shall be conducted earlier than 8:30 a.m. nor later than 10:00 p.m.
2. Noise limits. No event shall produce noise levels that interfere with or detract from the enjoyment of the surrounding area by the general public.
3. Limitation on use of artificial lighting. No artificial lighting will be allowed unless it is sufficiently maintained and directed within the park area and specifically shielded and directed in a way that does not cause artificial illumination of areas outside the park including the sky.
 

D. Wawatam Park. No activity requiring a permit under this ordinance will be allowed in this area, except public special events.
 

E. Alexander Henry Park. No activity requiring a permit under this ordinance will be allowed in this area, except public special events.
 

F. All other public parks and areas. No activity requiring a permit under this ordinance will be allowed in this area, except public special events.

40.156 Failure to obtain permit.
Sec. 6. Any group, person, association or organization that fails to obtain a permit before using public premises for purposes set forth in Section 2 [40.152] shall be considered a public nuisance per se and be enjoined by order of the Circuit Court.

40.157 [Regulations and restrictions.]
Sec. 7. The following regulations and restrictions apply to all village public park areas unless specifically waived by the village council.

A. No camping.
B. No littering.
C. No use of alcoholic beverages.
D. No open fires.
E. Children must be supervised.
F. Vehicular parking must be in designated parking areas.

40.158 Penalty.
Sec. 8. Any violation of this ordinance shall be a civil infraction punishable by a fine of not more than $500.

40.159 Effective Date.
Sec. 9. This amendment to Ordinance #130 shall become effective twenty (20) days after publication in a newspaper of general circulation within the Village of Mackinaw City. All ordinances or part of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.
